Terms of Service

1. Who You Are Agreeing With

These Terms of Service ("Terms") are between you and [YOUR LEGAL NAME / COMPANY NAME] ("NOEZDAY", "we", "us"), the developer and operator of the NOEZDAY application. By creating an account, downloading the app, or using noeasyday.app, you agree to these Terms.

2. What NOEZDAY Is

NOEZDAY is a behavioral stabilization and life-discipline platform. It provides breathing exercises, grounding techniques, journaling, daily check-ins, XP-based progress tracking, and structured challenge programs (RESET, REBUILD, ASCEND).

3. Eligibility

You must be at least [13 / 18] years old to use NOEZDAY. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly allow children under [13 / 18] to create accounts.

4. Your Account

• You are responsible for maintaining the confidentiality of your login credentials
• You are responsible for all activity that occurs under your account
• Notify us immediately at hello@noeasyday.app if you suspect unauthorised access to your account
• You may not create an account on behalf of another person without their express permission
• You may not create multiple accounts to circumvent subscription restrictions or level restrictions

5. Free and Paid Plans

NOEZDAY offers three plans:

• Starter (Free) — access to core tools with no time limit. The Starter plan remains free. We will not retroactively charge for features that are currently free.
• Pro (₹199/month) — access to full breathing library, meditations, sleep tools, 14-day challenges, and 4 daily micro-actions
• Premium (₹499/month) — full access plus 1.5× XP multiplier, 6 daily micro-actions, all challenges, weekly insights, and early access to new features

SOS tools and crisis helplines are free on every plan, permanently. This will never change.

6. Billing and Subscriptions

• Subscriptions are billed monthly in advance through [Razorpay / the App Store / Google Play]
• Billing renews automatically unless cancelled before the renewal date
• Prices are in Indian Rupees (INR) inclusive of applicable taxes
• We reserve the right to change prices with 30 days' notice to your registered email address
• If you subscribe via the App Store or Google Play, billing is managed by Apple or Google respectively, and their payment terms apply

7. Cancellations and Refunds

• You may cancel your subscription at any time. Access continues until the end of the paid billing period.
• Refund policy: [e.g. "We offer a 7-day refund for new subscribers if requested within 7 days of the first charge. No refunds for subsequent billing cycles." — choose your policy]
• If you subscribed via the App Store or Google Play, refund requests must be directed to Apple or Google.
• We may, at our sole discretion, offer refunds in exceptional circumstances.

8. XP, Levels, and Progress

• XP (Experience Points) and level badges are earned through genuine use of the app. They cannot be purchased.
• Premium subscribers receive a 1.5× XP multiplier. This multiplier only applies to XP earned while your Premium subscription is active.
• We reserve the right to adjust XP values or level thresholds with notice. Any such change will not retroactively reduce your existing XP.
• Progress data is tied to your account. If you delete your account, all XP and level progress is permanently lost.

9. Acceptable Use

You agree not to:

• Use the app for any unlawful purpose or in violation of any Indian or applicable international law
• Attempt to reverse-engineer, decompile, or extract the source code of the app
• Attempt to gain unauthorised access to our servers, databases, or other accounts
• Use automated tools, bots, or scripts to interact with the app
• Impersonate another person or entity
• Share your account credentials with others or sell access to your account
• Upload content that is illegal, harmful, defamatory, or violates the rights of others

10. Your Content

Journal entries and other content you create in the app ("Your Content") belong to you. You grant NOEZDAY a limited, non-exclusive licence to store and process Your Content solely to provide the service to you. We do not use Your Content for advertising or share it with third parties.

11. Intellectual Property

The NOEZDAY name, logo, app design, challenge programs, XP system, level names (Recruit, Operator, Elite, Unbreakable, Legend), and all associated content are the intellectual property of [YOUR LEGAL NAME / COMPANY NAME]. You may not reproduce, distribute, or create derivative works without our written permission.

12. Third-Party Services

The SOS feature connects you to independent crisis helplines. We have no control over these services and are not responsible for their availability, advice, or actions. The adventure activities section of the app will, when launched, involve third-party activity providers. Participation in those activities is at your own risk and subject to the third party's own terms.

13. Disclaimers

NOEZDAY is provided "as is" and "as available". To the maximum extent permitted by Indian law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the app will be uninterrupted, error-free, or that any specific results will be achieved through its use.

14. Limitation of Liability

To the maximum extent permitted by applicable Indian law, NOEZDAY and [YOUR LEGAL NAME / COMPANY NAME] shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits arising from your use of or inability to use the app. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless NOEZDAY and its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising out of your use of the app, your violation of these Terms, or your infringement of any third-party rights.

16. Termination

• By you: You may stop using the app and delete your account at any time.
• By us: We may suspend or terminate your account if you violate these Terms, with or without notice. In the event of termination for cause, no refund will be issued for the current billing period.

17. Governing Law and Disputes

These Terms are governed by the laws of India. Any dispute arising from these Terms or your use of NOEZDAY shall be subject to the exclusive jurisdiction of the courts of [YOUR CITY, e.g. Mumbai], India, except where mandatory arbitration is required by applicable law.

Before initiating legal proceedings, you agree to first attempt to resolve any dispute by contacting us at hello@noeasyday.app. We will attempt to resolve disputes informally within 30 days.

18. Changes to These Terms

We may update these Terms from time to time. We will notify you via email and/or an in-app notice at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.
